I would never have voted to confirm someone who advocated the inclusion of a "notwithstanding clause" in the U.S. Constitution.

Why? It's irrelevant to his judicial philosophy.

Hmm, very good point. I will have to retract that statement (a few months late, of course).

On the whole, he seems to be an excellent jurist. He has argued that the privileges or immunities clause is an "inkblot"; in other words, he wants it ignored completely. So, if he opposes incorporation, I would have to vote against him. But aside from that point, I see nothing wrong; his judicial positions are quite admirable.

I would have voted for Bork, and every other member of the court except Ginsberg (sp?). She actively campaigned for the position years before her first confirmation hearing.

He candidly answered questions on his personal views and senators disregarded his qualifications and judicial philosophy because of it. His "no right to privacy" comment didn't help either, even though he was 100% correct.
