Definitely! And he would have been far superior to that leftist Anthony Kennedy who eventually took the position.

Yep. Right up there with James Madison and the people who actually wrote the Constitution.

Did you ever consider that the situation today is a little different than the situation in the 1780s?

Yes, and if the Constitution is ever outdated, there is an amendment process.

No, and your contrasting example of the eventual result - Anthony Kennedy - shows why it is so important to 'Bork' bad nominees, if possible.

I'd probably hold my nose and vote yes.  I deeply dislike the man, but he at least fully understood the actual position of the American judiciary.

Can I ask why the poll is divided so that Republicans and Libertarians are together, and Democrats, Independents and Others are together?

I would never have voted to confirm someone who advocated the inclusion of a "notwithstanding clause" in the U.S. Constitution.

No, although I would have confirmed every current member of the Court.

As an aside, although I strongly disagree with many of them, I would vote to confirm all of Bush's judges EXCEPT Pickering and Owens.

Charles Pickering
Priscilla Owens

2 of the Bush judicial nominees.  He's a racist who has written in favor of segregation.  She's a blatant crook several of whose decisions have been called "blatant judicial activism" by Attorney General Alberto Gonzales.

Back it up or shut up? I really believe its more along the lines with the liberals of "We don't want those n*ggers getting uppity now!"

Ok, what would you like me to "back up"?  The Gonzales statement about Owens?  Or the Pickering law school paper wherein he favored segregation?

Ok, let's do Judge Owens first.  From her home town newspaper ....

She seems to be precisely what is needed. If she stands strongly in favor of parental notification then I am all for her.

In other words, "judicial activism" is ok as long as it goes in your favor.
