It can't. And most of us agree with your first sentence, which is why this topic is an interesting one, since it adds shades of gray to the views of those who believe the woman should be allowed to get them freely up to a certain point.
You'd pretty much have to ban abortion after it's possible to tell the baby's gender. If angus is correct, that would be @ 20 weeks.
Sex, DC. Gender is something the baby will come to identify when it is older and comes into its own.
You could forbid doctors from telling the parents what the baby's sex was. But you'd inevitably have doctors taking bribes under the table to tell you. Or, worse, parents buying ultrasound machines and attempting to use them themselves to figure out the sex, which could go horribly wrong.
