For anyone who needs clarification:

Murder in the first degree is murder which is preplanned.

Special circumstances are criteria used in some states to classify the most henious forms of murder (Murder/rape, murder/torture, murder for hire, etc)

Murder in the second degree is when the murder is not planned in advance (often a crime of passion), but the accused acted with apperent intent to kill.

Manslaughter is an unintentional killing, either in violence without lethal intent (some fights), or gross neglegence (as a result of drunk driving, for example).

Crimes against humanity are a legal fiction becasue groups can't be the target of crimes. They are crimes against a very large number of individuals, but not crimes against humanity.

I voted for large-scale murder and murder with special circumstances.

I don't support the defined death penalty for anyone; however, if someone attacks our country (Osama) he/she should be found and killed so as to prevent something awful like this from happening again.

You should have broken down the category for "other" meaning manslaughter and rape. I don't agree w/the death penalty for manslaughter but I definately think child rapists should be executed w/special circumstances. No, a 18y.o. messing w/a 17yo girl shouldn't get death but a 40yo perv messing with a 8 y.o. should be eliminated immediately.

I would also apply the death penalty to crimes where the criminal  used extreme brutality and/or cruelty and caused severe injury to his victim.

For once I agree.  A lot of public works programs could be done if the work force is free.  Like slavery, but they actually deserve it.

Everything down to murder in the second degree. Not that I would usually favor the death penalty in such a circumstance, but if by subject you mean there is a *possibility*, then yes, it would depend on the individual circumstance.
