Levin's suggestion is a good one, but I believe Reid does this when it happens.

As Link alluded to, the very first thing Republicans will do when they win a majority in the Senate is end the filibuster. Democrats should end it now while they can still gain an advantage.

This exactly.  The filibuster is dead the day Republicans take over the Senate, at least under current conditions.  They'll never give us the right to filibuster, so why should we let them have it?

Why would they get rid of it? They use it a lot more than Democrats. That asymmetric warfare is working out well for them.

Because they always want more, more, more.  It's not going to stop.  If Reid can consider the nuclear option what do you think a Republican high on Tea Party fumes will be willing to do?  The Dems need to do a premptive strike.  Plus if they fill all the vacancies it's not like there will be a ton of vacancies available for the next 2-4 years.

So basically they could fill 11 percent of the federal district and appellate courts in one session.  With natural turnover how many vacancies would become available for a Republican Senate?

Instead of pubs complaining about case loads, they should instead get behind term limits of federal judges. They haven't done this, due to the fact they held the prez so long. 3 Supreme CRT vacancies are gonna come up and should they remain in minority, this will do them good.

Ok, if it passes he'll regret it later.  Should be fun.

Maybe even McConnell is so fed up with the culture of obstruction that he's pushing things to the limit to break them. Otherwise, he'd be under pressure to keep obstructing everything. Reid would have the same pressure as minority leader but it's much easier to ignore and shut down on the Dem side for various reasons.

Yeah, there might have been some chance for a deal (three Republican senators voted present on the last vote, which would have been 60 votes if all three changed to yes), but Reid apparently doesn't want a compromise. Good.

No, that was the second (I think) cloture vote on the nominee today. Cloture has to fail a few times before they're allowed to change the rules, from what I understand.

Reid's moved to change the rules. McConnell's raising points of order.
