Not legally.  The Pure Food and Drug Act of 1906 banned cocaine.  Coca-Cola had actually stopped using cocaine a couple of years earlier because cocaine was getting bad press.  Don't know if Pepsi ever had cocaine or not.

All that bad press is probably why that guy was so adamant on banning soft drinks, in my opinion.
