Yes, every American pays an equal amount on each dollar they make – up to the different levels. And every American has an equal opportunity to marry someone - of the opposite sex. No one is being denied anything on account of ethnic, religious, or regional profiling.

Correct - but they are being denied equal protection due to gender profiling.  I suppose the ERA didn't pass.. I don't know if that means that it is OK to discriminate against people based on sex whenever you want.  I doubt it because I believe women can sue when passed up for promotion in favor of men.

Also I suppose an argument could be made that this is religious descrimination, since male/female marriage of a monogamous sort is the preference of some religions.  Perhaps others exsist, or could be created as a false front, that prefer or would prefer same sex marriage.  Additionally, the Mormons already exsist, and have been discriminated against for years by legal prevention of their religious preference for polygamy.

And wealthy people are being denied equal protection due to income profiling.

Income is not a property that you are born with and is unchangable or, like religion, is almost impossible to change.

gay marriage should be recognized.  the government has no right to tell people who they can or cant marry.

Why?  If marriage between blacks and whites (or at least black men and white women!) had been put on the ballot, it would never have passed in the South.  Heck it wouldn't pass in Alabama TODAY!

No, relying upon the majority to gaurantee individual rights never works - they're almost always hateful bigots.

Entirely irrelevant. If government can treat my income differently, it can treat relationships differently.

my view is simple: judicial activism is right when I agree with it and wrong when I disagree with it.

I've always been an ends justify the means guy.

And you still say you are not a Stalinist?

Your answer is immature and actually exceeds the level of intellect I have come to expect from you.

I honestly don't care that much about this issue.  I used to be a little worried about the inheritance tax, but income tax really doesn't bother me much.

Oh, okay. So judges should only worry about "inequality under the law" when it's something you care about.

Oh, okay. So judges should only worry about "inequality under the law" when it's something you care about.

The income tax is not 'unequal' - all individuals face precisely the same tax system.  If the poor suddenly get a lot of money, they pay the same higher rate.  If the rich suddenly decide it is better to be poor, and get rid of their money, they subsequently pay a lower rate.

A tax system comparable to the situation with gay marriage would be one in which homosexuals were robbed of all their income, while heterosexuals went tax free.

I'll never forget an occasion when I was sitting around complaining about the capital gains tax at a friends house, and his aged New Deal Era mom came in and said 'you should have such problems!'.  Wise woman.

And all people face exactly the same marriage requirements - having a partner of the opposite sex.

Then what's wrong with a requirement that you have a partner of the same race?

What's wrong with it or what's illegal about it? The answers are a lot and nothing, respectively.

So a ban on interracial marriage would be - by the same 'reasoning' - equal treatment.  A white woman would not be banned from marriage just because she could not marry a black man eh?

It blatantly violates equal protection, just like the ban on gay marriage.

Actually, plenty of people, like George W Bush are born rich.
