I wouldn't think a concession would necessarily constitute a vacancy, since whoever held the seat before still holds it. In fact, if the appointment is made before the first Friday of the next month, then the seat would clearly not be vacant since it was never left vacated.
The big issue arises if the appointment is not made before the date the duly-elected Senator would have sworn in.
