Oh, and even though most people are not denying that GPORTER did delete his vote after closing time.....I did ask him in a PM, and he did indeed confirm that.

I also saw Gporter's vote. However, do we have confirmation from anyone beyond Gporter himself that the post was actually deleted after the booth closed? Because otherwise it would actually not count, correct?

I actually do support a law suit to the extent that this isn't clear, because legislation obviously needs to be crystal clear on an issue like this.

I am looking into that right now and will follow the case wherever it may take me.

Since I saw gporter's vote myself, I will not be contesting the election results myself.
And so you give meaning to your election slogan - "because every vote counts"! Cheesy

Well....my statement at least. I know for a fact I counted the vote THIS MORNING several hours after voting had closed.

And of course his PM admitting it.

After making this post (note the timestamp)

81 votes, quota of 21. Shua +1, with surplus to Ernest. 3 for Oakvale and 1 for Snowguy.

I renewed the ballot thread in another tab to see if any additional votes had come in behind jfern (they had not). Before I then prepared the last update to my election ticker, I did check the forum time on the ballot thread to see if it was past 6:00:00, and it was, by a few seconds, though the thread was not yet locked. Gporter's post was certainly still in existence at that time.

The voting booth was locked.....at most.....a minute after voting was officially closed.

edit: not to mention that when the booth was closed is actually irrelevant because any chance after 6pm wouldn't count anyway.

I know that, I mentioned it only because I remember noticing it at the time.

Oh sure, I appreciate it!

It seems quite clear that GPORTER's vote existed.....and also was in the booth after 6pm (it was also there about 12 hours later...Smiley).

This is an interesting development to be sure. Hats off to Ernest and Franzl for handling this like grown-ups (though nothing against people wanting to challenge this in court; it's their right, though one might ask why if Ernest isn't contesting the matter then......Huh)

At any rate, there probably should be legislation dealing with this scenario. I can't imagine any reading of federal election law that intends or permits one to sabotage an election by deleting their vote after polls closed, theoretically even weeks or months later.

For the record, I saw Gporter's vote and I am almost sure the booth was locked when I saw it (I was recounting the election's results Wink). It is clear that his vote should be counted, and I wonder why wormyguy is trying to mess up things again.

The problem is more that the vote was deleted before Oakvale swears. So the result is still debatable.

If somebody deletes his vote in a March 2009 election, indeed, it has no effect.
Here, it's a bit different.

I'm not supporting this lawsuit, as Franzl hasn't made a mistake and as Ernest has himself conceded, but let's at least acknowledge it's an interesting one and not at all stupid. The game is here for this, isn't it Wink ?

Law isn't clear enough. Badger is right.

No, it's not. The rightful election results are the results at the moment when the thread is locked, period.

I am no longer pursuing a case against the DoFE, however I would be very interested to see the SoFE's legislative proposal as I intend to introduce legislation to address the relevant issues.

If you know me you will notice I tend to take things far too seriously than I should. Tongue Still, it was an unmotivated suit and I'm glad Shua finally acted like a reasonable person.
