Too oversimplified of a statement.  While the child might not be abused or mistreated, if one parent is involved in a lifestyle which could put the child at risk without the other parent there as a stablizing unit (for example, the father is involved in drugs/alcohol, but never harmed the child since the mother was there as a buffer), then no, the one parent would not be allotted equal custody.

I agree in your example that there are specific cases where the parents shouldn't have equal custody. However, someone's gender alone should not be a reason to not give them equal custody.
