Quote
Newsmax host Grant Stinchfield ludicrously accused incoming Supreme Court Justice Ketanji Brown Jackson of leaking the court’s majority draft opinion overturning Roe v. Wade, confidently declaring Tuesday night that “she would be my first suspect when it comes to the leak.”

There’s just one problem with Stinchfield’s theory: Jackson doesn’t even join the court until after the current term ends this summer.

Given that everything is always projection with these guys, this just bolsters the theory that a hardline conservative leaked it to try & lock-in the 5 votes from Feb.

She isn’t even on the court yet? Proves yet again that Newsmax isn’t real news!

His logic is that her clerks have probably been hired and are somehow already working at the Supreme Court. *shrugs*

To be fair, they probably have already been hired, but they're sure as hell not in that building 'til she's in that building.

I'm sure she's interviewing clerks, but I doubt she's officially hiring any clerks until August at least.

SCOTUS clerks are typically hired years in advance; newly confirmed justices already have them hired upon taking office.

I think newly confirmed justices often borrow clerks hired by their predecessor or by their fellow justices; they don't hire "their own" clerks in advance like that. Also it depends a lot on the justice. Most of the conservatives stack two, three, four years in advance; the liberals seem to do this a lot less often.

You're thinking of what happens to clerks when the justice who employs them, for whatever reason, is no longer a justice mid-term; they get shuffled around so they can finish the year under another justice. In terms of newly confirmed justices, however, they're already hired upon swearing-in & need not even be law students in their 20s: one of Gorsuch's immediate hires was just a friend of his willing to help out.

To clear things up:
1. Jackson has officially hired all four clerks for the upcoming term; hiring was finalized in April.
2. Newly confirmed justices do "borrow" clerks, though not in the same way as clerks whose justice died (obviously it's difficult to borrow a clerk who is currently assigned to a full-time justice) — it is typical to hire one or two clerks who have previously clerked for another justice for one's first term to help get your footing on the Court.
3. Newly confirmed justices expedite the hiring process by selecting from a limited pool, typically clerks who previously worked for the Court and are interested in clerking again as well as that particular judge's former clerks. Jackson's clerks for the upcoming term include two former SCOTUS clerks and two former Jackson clerks.
