The argument was based on the federal power and process and not the 5th amendment fyi.

Anyway dumb decision because Kavanaugh thinks its illegal but it should stay till July 31 anyway.  I think it was 5 4. I mean the idea that something illegal is happening but should be allowed is a wth.

Kavanaugh is spot-on here: yeah, the eviction moratorium may be on pretty shaky ground legally speaking, but the overall balance of the equities - &, not to mention, the fact that this case will be moot in a month for god's sake, let alone before it ever would've made its way back to the Court - favors keeping it in-place so that it's able to be wound down in as competent a manner as possible by the feds, who've already confirmed to the Court that 7/31 was the last extension.

Plus, judicial restraint being invoked in a shadow-docket case is just so great to finally see for once.

A surprising decision. Given the current makeup of the Court, I would have fully expected them to strike it down. If you voted for Trump, blood is on your hands.

Yeah, this was legitimately one of the weirder things that has ever been done under CDC authority, but I'm glad to see 5 votes to give tenants the benefit of the doubt in the short run.
