It shouldn't matter--I don't think that the Convention is required to treat the relevant section of the resolution as binding.

It doesn't, as it says it's just a request, nothing has to come of it.

If I can vote in favor of striking Clause 4 I do so now, and then vote Aye for the Convention Resolution as a whole.

If it's too late to strike Clause 4...well, I don't want to defeat the Resolution over this matter, but I agree with the objections to Clause 4. In that case I vote Aye and ask the President to line-item veto Clause 4.

Just to be clear, I can't line-item veto this because a.) it's a resolution, not a bill and b.) my line-item veto power applies only to legislation that draws money from the treasury.

Aye, I guess, as long as we're sure that the convention can just blatantly ignore clause 4.

So if Clause 4 is mere suggestion, then what of Clauses 2 and 3?

Article VII, Section 2 states in part:

The Convention shall be constituted under regulations determined by the Senate.

Clause 4 of the bill is such a regulation. The Convention may not simply ignore it.

This resolution has enough votes to pass. Senators now have 24 hours to change their votes.

The Senate may only regulate how the "Convention shall be constituted," i.e., the composition of the Convention. The composition of the Convention is different from its agenda.

In any event, Clause 4 states that the Convention shall discuss the system of government. It does not state that the Convention shall discuss only the system of government.

I suppose this is one way of spinning it.

In all honestly, I really would not have cared if we had to bend the rules slightly just to resolve a headache.  There are times when we have such excessive legalism and attention to technicalities that I feel we've forgotten what keeps most people here.
