The only reason Operation Eagle Claw saw no fighting is the helicopters broke down before reaching Tehran. Carter was spared fighting by happenstance.

The U.S. hasn't declared a war since 1942.

War Powers Act: passed in 1970, gave the power to make war, to the presidency, most notable, Reagan, who fought various guerilla wars that weren't declared. Which gave rise to Operation desert storm and the Balkin War: Kosovo, Bosnia, and Libya.

The Congress has the power to end the war.
