Preamble:

We the people of the states consisting of Alaska, Arizona, California, Hawaii, Idaho, Nevada, Oregon, Utah, Washington and Montana shall come to form a region that will hence forth be known as The Pacific Region. We shall define our laws after our forums constitution and abide by them as well as put into place our own.

Article I (Propositions and Petitions)


Section 1(Proposition)

Clause 1, Propositions shall be law, regulations, and or state constitutional amendments voted on by the people of the Pacific Region during General and Mid-Term elections

Clause 2, Propositions maybe introduced by the Governor or they maybe solicited by the people via the signing of a petition. The Petition must have at least 5 signatures for it to be put up to a vote.

Clause 3, For a Proposition to pass it must receive over 50% of the vote.

Section 2 (Petitions)

Clause 1, A Petition must be in the form of a thread in order for it to be recognized.

Clause 2, The 5 signatures that a petition must receive to get on the ballot must come within the first week of the petitions existence.

Article II (Office of the Governor and Elections)


Section 1(Powers of the Governor)

Clause 1, The administrative Authority of the Pacific Region shall herein be vested in the office of the Governor.

Clause 2, The Governor may propose any proposition that does not contradict the Regional (unless it is an amendment) or Federal Constitution and shall be voted on by the people in the closest election following the proposal.

Clause 3, The Governor may Veto any Proposition that does not have 60% of the vote from the people of the Pacific Region.

Section 2(The Governor and other Regional offices)

Clause 1, if no one has been elected to one of the needed regional offices in the Pacific Region the Governor may choose to select a person to fill the office or if no one is willing to take the office the Governor may conduct the duties of that office.

Clause 2, If for whatever reason the Governor is unable to perform his duties the Lt. Governor shall take his place

Section 3(Gubernatorial and other Elections)

Clause 1, All elections for regional offices shall be held during the mid-terms except. for Gubernatorial Recall elections

Clause 2, For a Governor to be recalled 8 voters must sign a petition and all 8 signatures must be gathered within 2 weeks of the creation of the petitions thread. Then a Proposition shall be on the ballot in the general election on whether to recall the current Governor as well as a list of gubernatorial candidates to replace the Governor if the Recall passes. Note a recall and only be on the ballots during the General elections

Clause 3, If there is a tie with more than 2 candidates receiving votes, and there have been votes cast for someone other than the tied candidates that are not tied for that office there shall be a special election held that following week between the tied candidates.

Clause 4, If there is a tie in which all the candidates have received the same amount of votes the Governor (or winner of the next highest office if the office being disputed is the Governorship) shall choose one of the candidates to fill that position.


Article III

Section 1(Lt. Governor)

Clause 1, The Lt. Governor shall replace the Governor if he steps down, is on vacation, or has been inactive for 2 weeks.

Section 2(Controller)

Clause 1, All duties regarding elections shall herein be vested in the office of the Controller.

Clause 2, The Controller will be responsible for setting up voting booths for the Pacific Region and  in charge of making sure the election is run fairly and justly..

Amendment I
 
Pacific Region shall follow the rules, regulations and laws as put forth by our Forums Constitution..


Propsitions that have been passed and are now enacted.

Proposition 01 ”The Controller Elimination Act”: The elimination of the office of the Controller by completely eliminating article 3, Section 2 of the Pacific Regions constitution.

This Act shall also put the duty of the controller into the hands of the Lt.Governor. If there is no Lt.Governor the Governor will be in charge of those duties.


Proposition 02: "Petition Clearification Act"
Article 1, Section 2, Clause 2, The 5 signatures that a petition must receive to get on the ballot must come within the first week of the petitions existence.

Shall now read

Article 1, Section 2, Clause 2, The 5 signatures that a petition must receive to get on the ballot must come within the first week of the petitions existence and all signatures on petitions must come from citizens of the Pacific(this includes Recall petitions).

Proposition 03: "The Preferential Voting Act"
If this act is approved preferential voting will be put into effect for all Regional offices.(just like it is for all Federal offices now)

Proposition 04: "The Capitol of the Pacific"
Please list the 3 cities you'd most want to have as the capitol of the Pacific. All cities listed must be from AL, AZ, CA, HI, ID, MT, NV, OR, UT, WA. The top ranked city in any givin valid ballot will get 3 points, 2nd will get 2 points, 3rd will get 1 point.

San Francisco recieved the most points

Proposition 05: "The Welcome Montana Act"
If passed the state of Montana will be added to the preamble of the regional constitution.

I have decided since 2 citizens of this region(PD, Mossy) have not posted in ages we have atleast half of the region behind this document and I've decided that this Friday will be the final day Pacific citizens may ad their name to this document.

Propositions that have passed and have now been enacted.

The Medical Marijuana Legalization Act
This Act if passed will legalize Medical Marijuana within the Pacific Region.

The Children's Hospital Act
Authorizes $1 billion over 15 years for grants to eligible children's hospitials [sic] to construction, expansion, renovation and equipment.

Family Day
Every first Monday in each atlas fiscal year will be Family Day. Where workers get to come home in and spend some time with the family.

The Pacific National Guard Expansion Act
This bill establishes a fund that will supply our troops with adequate training, body armor, and top of the line equipment. Total cost will be $2.5 billion dollars over 10 years and will be mostly funded through bonds and grants from the Department of Defense.

Candidate and Proposition Deadline Act
If passed this proposition will make it so all candidates must announce their candidacy at least 3 days before the first election day and all propositions must be on the ballot by that same time.

Science Tax Cut Act
If passed for each $100,000 a company spends purely on research projects focused on space exploration research, stem cell research, finding newer and more efficient fuels etc. the company will receive $5,000 tax rebate.

The Pacific University Initiative
This proposition hereby allocates $2.1 billion over 25 years to establish the first public universities for Atlasian regions. The main campus shall be located in teh alrgest state, California, and will be known as UPCalifornia, the first branch will be located in the second largest state, Washington, and will be know [sic] as UPWashington, the second and final branch's location  will be decided by the Governor of the Pacific based on bids by citizens of each state.

Term Limits Act
No Governor or Lt. Governor may serve more than 4 consecutive terms in one office.

All of these propositions passed, 10th-12th December, by veto-proof majorities of over 60%.
If the clause "60% of the vote from the people of the Pacific Region" is to be interpreted as 60% of valid votes cast on that proposition, that is. We have received word from the Governor's office that this is the correct interpretation of the law.

I would conisder all abstainations as the vote being left blank. Thus Prop 1 has a veto proof majority.

three Amendments and one Law that have been voted on by the people and are now being enacted:

The Open Legislature Amendment
§1. This amendment hereby abolishes the ballot proposition system outlined in Article I, Section 1 of the Pacific Constitution.

§2. All laws, decrees, and amendments shall be proposed and voted on by an open legislature.  The legislature shall consist of all registered voters in the Pacific region and legislation can be proposed at any time.

§3. Once a new law, decree, or amendment is proposed, the Lieutenant Governor must open a vote on the proposal lasting seven days. For the proposal to pass, it requires a majority vote of more than 50%

§4. After the proposal has passed, it shall be sent to the Governor for signature or veto. The Governor cannot veto the bill if more than 2/3 of the legislature (that voted) approved of it.

The Judicial Authority Amendment
The Lieutenant Governor shall be given the power of chief judicial officer. As the chief judicial officer, it is the Lieutenant Governor's duty to interpret the Pacific Constitution and regional law.

The By-Elections Amendment
Clause 1, Section 2 Clause 1 of the Pacific constitution is hereby repealed.
Clause 2, in the case of a vacancy in the Lt.Governorship due to death, resignation, ascent to the governorship or any other reason, a by-election shall be held on the weekend (Fr. 0.00 am to Su. 11.59 pm) of the week after the week in which the vacancy occured. This by-election shall be administered by the Governor.
Clause 3, the Lt.Governor may be recalled by the voters, using the same procedure as in the case of the recall of the Governor.

Pacific Statute on Prescription Medication

1. All those State funded programs relating to offsetting and subsidising Prescription medication that is provided for in this Statute is hereby cancelled.

2. The Regional Government shall subsidise Prescription Medication purchased by patients and/or their families that shall meet the following criteria:

i. The Medication is essential for maintaining the life or the quality of life of the patient being treated. Determination of essential shall be made by the qualified physician principally responsible for treating the patient.

ii. The Medication shall have been accredited by the independent panel of experts described in Section 5.

iii. The Medication shall be the most clinically effective available, and shall have this effectiveness supported by at least one clinical study.

iv. The Medication purchased shall be the least expensive of the generic form of the Medication.

3. Quality of Life Medication

i. Once a patient (or their family) shall have spent $5000 on Medication for the purpose of maintaining the quality of life of the patient in one fiscal year, the Regional government shall subsidise Medication purchased for the purpose of maintaining the life of the patient at a rate of 40%.

ii. Once a patient (or their family) shall have spent $10000 on Medication in either this Section or Section 4 in one fiscal year, the Regional government shall subsidise Medication purchased for the purpose of maintaining quality of life at a rate of 60%.

iii. Once a patient (or their family) shall have spent $20000 on Medication in either this Section or Section 4 in one fiscal year, the Regional government shall subsidise Medication purchased for the purpose of maintaining quality of life at a rate of 80%.

4. Life Saving Medication

i. Once a patient (or their family) shall have spent $2000 on Medication for the purpose of maintaining the life of the patient in one fiscal year, the Regional government shall subsidise Medication purchased for the purpose of maintaining the life of the patient at a rate of 75%.

ii. Once a patient (or their family) shall have spent $10000 on Medication in either this Section or Section 3 in one fiscal year, the Regional government shall subsidise Medication purchased for the purpose of maintaining quality of life at a rate of 95%.

iii. Once a patient (or their family) shall have spent $20000 on Medication in either this Section or Section 3 in one fiscal year, the Regional government shall subsidise Medication purchased for the purpose of maintaining quality of life at a rate of 100%.

5. Expert Panel

i. The Regional government shall appoint an eleven member panel of experts to determine that Medication which shall be available to be purchased under Section 2.

ii. Experts in this context shall extend to pharmaceutical industry representatives, healthcare specialists and medicinal scientists.

iii. The panel shall be able to use the criteria they deem appropriate to determine the clinical effectiveness of Medication.

iv. The panel shall also be responsible for determining the effectiveness and sustainability of the scheme outlined in this Statute and shall report every two years to the Regional government on the same. The panel shall have the assistance of government auditors in carrying out this duty.

6. Funding

$220 million, with appropriate adjustments for inflation, shall be appropriated every year to finance this scheme.

(a).  Article II, Section 3, Clause 1 of the Pacific Constitution is hereby repealed.

Section 2
(a).  Elections for Governor and Lt. Governor shall be during the months of April, August, and December.    The elections in April and August shall be held the second to last weekend of the month on the days of Friday, Saturday, and Sunday. The December elections shall be held the second weekend of the month during the days of Friday, Saturday, and Sunday in order to avoid the holiday season. Voting shall open at noon Pacific Time on Friday and end at noon Pacific Time on Sunday. The Governor and Lt. Governor shall assume their office during the first weekend of the month following the election, between noon Pacific Time on Friday and noon Pacific Time the Sunday ensuing.

ii. Once a patient (or their family) shall have spent $10000 on Medication in either this Section or Section 3 in one fiscal year, the Regional government shall subsidize Medication purchased for the purpose of maintaining quality of life at a rate of 95%.

iii. Once a patient (or their family) shall have spent $20000 on Medication in either this Section or Section 3 in one fiscal year, the Regional government shall subsidize Medication purchased for the purpose of maintaining quality of life at a rate of 100%.

5. Expert Panel

i. The Regional government shall appoint an eleven member panel of experts to determine that Medication which shall be available to be purchased under Section 2.

ii. Experts in this context shall extend to pharmaceutical industry representatives, healthcare specialists and medicinal scientists.

iii. The panel shall be able to use the criteria they deem appropriate to determine the clinical effectiveness of Medication.

iv. The panel shall also be responsible for determining the effectiveness and sustainability of the scheme outlined in this Statute and shall report every two years to the Regional government on the same. The panel shall have the assistance of government auditors in carrying out this duty.

6. Funding

$220 million, with appropriate adjustments for inflation, shall be appropriated every year to finance this scheme.

The Regional Tax Act

Sales Tax
1.  All individual state sales taxes are hereby repealed and replaced with a Pacific Sales Tax of 4.06 percent.

2.  All prescription drugs and food items shall be exempt from the tax unless marked otherwise by the government.  All non-prescription drugs or over-the-counters shall be taxed at a rate of 1.10 percent.

Excise Taxes
1.  All individual state excise taxes on fuel are hereby repealed and replaced with a Pacific Excise Tax of 21.15 percent on regular gasoline, 21.60 percent on diesel fuel, and 20.10 percent on gasohol.

2.  All individual state excise taxes on tobacco products are hereby repealed and replaced with a Pacific Excise Tax of $1.14 per pack on cigarettes and a rate of 35% wholesale price on all other tobacco products.

3.  All individual state excise taxes on liquor are hereby repealed and replaced with a Pacific Excise Tax of $3.25 per gallon on general liquor and $0.45 per gallon on beer and wine in addition to the Pacific Sales Tax.

Income Taxes
1.  All income tax rates shall be decided by the individual states and collected by the Pacific government.

The SECOND Medical Marijuana Legalization Act

Section 1
(a).  The legislature of the Pacific region shall hereby legalize marijuana for medical use.

Section 2
(a).  All medical marijuana shall be grown on state farm subsides in undisclosed locations throughout the Pacific.

(b).  All marijuana grown by these farm subsides shall be distributed by the Pacific government.

Section 3
(a).  Only physicians with official medical marijuana prescription pads from the Pacific shall be given the ability to prescribe medical marijuana.

(b).  If a prescription pad is lost or stolen, the physcian shall be required to report the disappearance to authorities or face arrest.

Section 4
(a).  All pharmacies who have recieved distributions of medical marijuana shall be required to store the drug in a location out of the public's view or reach.

More propositions passed by the Pacific Legislature:

The Alcohol Reform Act
1) The legal age for the purchase and consumption of alcohol shall be reduced from 21 to 18.

The Official Animal of the Pacific Act

The owl recieved the most votes.

Pacific Concealed Carry Act

Section 1
Any citizen of the Pacific region who has completed a safety course on gun use may apply for a license to conceal and carry a handgun on their person in public areas. These licenses must be renewed every 5 years.

Section 2
The Govenor may enter into reciprocity agreement with other regions regarding concealed carry of handguns. If such an agreement is entered, concealed carry licenses issued by such regions shall be considered valid in the Pacific region.

Section 3
Any citizen of another region with which the Pacific region does not have a reciprocity agreement, may apply for a conceal carry license in the Pacific region. All rules for Pacific citizens regarding these licenses shall apply.

Section 4
Any person who has been convicted of a violent crime or robbery may not receive a license unless they have commited no crimes above a misdemeanor for five years in a row after having served their sentence and

    * having been legally employed for at least two years;
    * having been married to someone meeting the requirements of the previous bullet; or
    * being above the legally defined retirement age.

at the time of application.

Section 5
The cost of application and renewal of a license shall be $50. This money will go to maintaining the infrastructure to carry out applications and to pay for FBI background checks.

Section 6
Concealed carry of handguns may be disallowed in government owned buildings, including but not limited to court houses and schools. The policy for each building or building type may be determined by the government responsible for the building, be it federal, regional, state, or local.

Section 7
Private property owners may disallow concealed carry on their own property.

1) The Pacific Government, aftering viewing video tape in which Mike Naso admits to being a terrorist and a friend of Osama Bin Laden, bans Mike Naso from the Pacific Region.
