The constitutional option was in effect. So, it was symbolic by the GOP to vote for this. He would of been confirmed with 51.

Btw, when was the last time we've had a retired General in the Senate? I wouldn't be surprised if it was the last Confederate Brigadier John T. Morgan of Alabama.

The last Admiral was served far more recently (Jeremiah Denton).
