Mr. AG, the problem wasn't that they were encoded in an amendment, but that the nature of Article VIII was altered in the Fourth Constitutional Convention. The only role that the amendment played was to spur my concern, subsequent research and finally this case.
I wouldn't say that it wasn't substantively debated, the problem was that most of the debate centered around which names were to be chosen and not whether or not it was in our power to do so. It was Departments, Departments are 1.5.28 and thus completely in our power. You were on the verge of having me committed just for bringing the case since it seemed so crazy at the outset.
If you aren't given a reason to question pre-conceived notions, then one is highly unlikely to do so. We were both a little late in that regard, hence why this wasn't fixed in the Senate and why the Defense in this case was hobbled by mistaken assumptions at the outset.
