May it please the court that I file the following lawsuit:

I ask that the Court rule on the Constitutionality of the following legislation:

Quote

While I agree with the act in principle, I believe that the Assembly overstepped its Constitutional bounds in passing this "Act."  In fact, the bill was originally proposed as amendment, something that should have been voted on by the people and inserterd in the Constitution.  I feel that the Assembly has taken an executive issue and turned it into a legislative issue, violating Article I, Section 1, Clause 1 of the Mideast Constitution, which reads, "The Executive power of the Mideast shall be vested in the Governor."

I don't know if I can file this yet, since it hasn't technically gone into law until 3 days after (unless I bring it up to a public vote, which I may do if it looks as if this route is a dead end), so let me know if I'm even allowed to file this case yet.

I originally proposed it as an amendment because I was unsure of the exact nature such a piece of legislation would have to take. However, after further reexamination of the Mideast Constitution, I do not believe any unconstitutional act has been taken by passing this bill as legislation.

I do not reject the idea that nearly all legislation be viewed, discussed, and decided by the people; in fact, it is my preference and I welcome a proposition vote. However, I again will reiterate my defense of the actions of the Assembly in their passage of the Mideast Wiki Responsibility Act.

Ok here's my schedule:

1. Class from 9:30-10:45
2. Gym from about 11-12:30
3. Lunch from 1-??
4. Going to the grocery store after that with the gf
5. Packing up my sh**t here at my apartment/taking the clean dishes out of the dishwasher
6. On the internet

So that means I'll get to this today! Probably around 3-4, so stay tuned! Tongue

Well I know how I'm going to rule on this but I'll take the cautious route on this because it's not actually a law yet. File it and wait 3 days and then I'll rule on it unless you'd rather take the other option.

Shall I assume the ruling will be in favor of the Governor and begin the procedure for bringing this forward as an amendment to the Constitution?

There's no need for that.  It's included in the 3rd Constitution, which should pass.  If it doesn't, I'll propose it as an Amendment, that way the Assembly won't have to deal with it.  Just in case that doesn't happen, I'm about to issue an executive order placing the duty of updating the wiki in the hands of the Governor.

It can't hurt to take precautions. As much as I would like to see the 3C pass, I will only believe it when I see it. There is also no telling when the package will be finished and so to leave this out of the current Constitution would likely be a mistake.

I do applaud your executive order, but to ensure that future Governors under 2C (if there are any) abide by this provision as well, I will begin discussion of the Amendment.

You bring up valid points.  I will allow for the Assembly to continue its action, and then will bring the Amendment to a vote by the people.

A decision would be in order soon. Otherwise the law should go into effect, resulting in the ability of the Governor to appoint a justice to decide this case.

After review the Mideast Superior Court comes to the conclusion that the Mideast Wiki Responsibility Act violates Article 1, Section 1, Clause 1 of the Mideast Constitution in that it violates Executive Authority. Thus it is ruled unconstitutional.

You're thinking of the new constitution.
