My understanding is by default the materials will still be turned over. A court will have to rule that the materials be withheld while the merits of the suit are litigated. The court would need to be convinced that Trump has a substantial likelihood to win on the merits of the case, in order to put such a hold on the transfer of the materials to Congress. Trump could appeal that judgement all the way to SCOTUS.

The whole purpose of this BS is to delay the work of the commission. He's already used that "tactic" during his term in the WH: file countless lawsuits, no matter how ridiculous they are. Just to drag it and make people forget about the scandal at hand. That's the same playbook here. He wants to hinder commission as much as possible so that after the 2022 elections a GOP majority can just disband the committee and nobody bothers anymore what happened on 1/6 and what his role was.
