And how are they getting those communications to look at their content in the first place?  If it was by tapping into it at the foreign end, they would be in compliance with FISA and could have avoided all of this controversy by saying so.  I can't imagine that even the Bush administration would be so politically tone deaf as to imply that they were not complying with FISA when in fact they were.
