Section 2 (Right to Live Amendment)

While I share some concerns about the scope of how this would be interpreted, it has been my opinion for some time that the best way to save money long term is to provide preventable care and that denying that care on the basis of upfront cost is going to be more costly as disease worsens, productivity is decreased and life is in some cases for lack of care.

I tend to agree with Thumb's interpretation in the House side in that regard though I would be open to amendment to the language if there are concerns in that regards. Historically, the court even while heavily left dominated has been very restrained in interpretation and I don't think it is practical for the court to be dictating the details of how an objective is achieved, just that it is achieved.

As for Atlascare, it does provide preventative care and any region that opts out has to ensure their is a provider that likewise provides said care. What could end up being required is that the formula be revised to expand subsidization because Atlascare operates like Medicare in that it charges premiums. Those premiums are then subsidized on the basis of age and income and there are substantial groups that receive a 100% subsidization level including the "Obamacare expanded Medicaid pool", those on CHIP.

Where the formula probably would need to be revised is to expand the 100% group to a higher level relative to poverty and then further slow the descent from there. But these were things that should already been done based on the realizations made when Encke was Deputy GM about just how steep the dropoff ended up being when graphed in a visual diagram, something that wasn't so apparent when just testing various case studies against a formula, which is what was done in 2017 to determine adequacy. Visuals are always better.
