Last August, California made history in becoming the first state in the nation to end cash bail.

This law, which is based on California's new law, replaces the cash bail system with a three-tier evaluation system that local courts will use to determine an accused person's risk of failing to appear in court and whether they pose a threat to public safety.  In nonviolent misdemeanor cases, defendants would be released within 12 hours.  In other instances, defendants will be scored on how likely they are to show up for their court date, the severity of the crime they've been accused of, and the likelihood of recidivism.

Under the status quo, wealthy defendants are able to buy their freedom while poorer defendants, who cannot afford bail, are forced to sit in jail as they await trial.  Bail also pushes more people to plead guilty rather than wait indefinitely for trial, and this disproportionately affects black and Latino Fremonters who are more likely to be arrested.  This bill takes an important step toward making our justice system more equitable and fair.  The bill will also, when in effect, end the private bail bond industry in Fremont and move us closer to the goal of separating profit and personal wealth from the criminal justice system.

I will add the important caveat that this new proposed model is by no means perfect: while wealth will no longer be a direct factor in determining whether a person leaves or stays in jail, racial biases may continue to be a factor in determining whether a person is released from jail and detention numbers may increase if those who can post bail for minor crimes are not able to.  By the same token, however, the risk of over-detention should give courts the incentive to examine critically whether someone is a flight risk or a possible threat to public safety.

Nice to see Fremont considering this. If adopted, only Lincoln would have a traditional cash bail system.
