This bans certain local bans (AKA preemption).

These bans all exist/have been proposed somewhere. Feel free to ask me about specifics.

Sigh ...

Embarrasingly, My hometown in SW VA, where I serve as a city attorney bans trick or treaters 10 or older. I read an article back in October about I believe Portsmouths similar ban and the Article mentioned several more localities at least in Virginia restrict it by age. The argument is that it is "door to door solicitation without a permit ". Arguably you could apply with our police Department after age 9 to go trick or treating but its a hundred dollar fee and you have to undergo a background check and be fingerprinted.
