(though seriously, one could argue that the law actually violates the Establishment Clause as well... which is quite a feat, to have both clauses go in the same direction!)

This crime has existed since 1997, the new law just changes the penalty nomenclature (amending "Class D felony" to "Level 6 felony"). And the law doesn't penalize gay marriage applicants or anything though, because it only prohibits people from "knowingly providing false information" on a marriage application. A same-sex couple trying to apply wouldn't do this unless they didn't change the default genders on the form when they knew and realized they were supposed to do so: it's only a crime if there's an intent to lie on the marriage paperwork.
