to JFK, Bono, and Texasgurl---why not?  Preferential voting is technically unconstitutional, and this is how to fix the problem!

It could be deemed so, for Senate elections. As of now, nobody has, however.

I retract my vote and replace it with a Yea having re-read the amendment itself and thought briefly on it.

My only hope is that amendment will not lead to large-scale changes in the voting system by the Senate as the amendment grants them the power to, that was one of my problems with this.

Wait...it says the Senate has the powers to etc "unless specified otherwise in the Constitution"? So anything in there now remains valid? THis wouldn't change anything.

It possibly never had the power to specify the form of the Constitution if you subscribe to a theory of strict construction.

Well, obviously...and obviousl that theory isn't leading you anywhere.
That's not what I mean though.
The point was, the text of this amendment doesn't really repeal the clauses in the constitution that might be construed to mean that preferential voting is unconstitutional.

With six yeas to two nays, I declare this amendment to have passed the Senate and shall duly put it to the public vote.
