Upon the direction from the President of the Republic, as an Attorney General, I am seeking an authorization for the Federal Government to intervene into a Northeast affairs in order to conduct an election there, after Northeast authorities failed to do so, leaving the Region practically without a constitutionally set legislature.

We are seeking a permission to allow the Secretary of the Federal Election to conduct an election there.

I appoint Marokai Blue to be a special prosecutor in this case. He will shortly present the case.

The Northeast Region has been in a state of disarray for several weeks now. The Chief Judicial Officer of the Northeast (Mr. Moderate) has not certified election results in the Northeast Assembly elections since the last election results. (Found: Here)

The Governor of the Northeast at the time, was RowanBrandon. Due to the lack of certification and vote counting, the Northeast Assembly was unable to do any business whatsoever. Election winners didn't take office. Nothing happened at all.

The current month's elections  are a repeat of this disaster. The Northeast Governor has neglected to open a voting booth, and the Assembly, since it hasn't been able to legally form to do business, is unable to intervene on it's own. RowanBrandon then resigned today, but his successor has yet to take action.

I resign. Someone else open up the damn booth then.

This has left the Northeast Region in a state of chaos, and today, President Purple State declared the entire Northeast Region in a state of emergency.

The President has requested the following:

Executive Action

After consultation with the Constitution and executive officers, I direct the Attorney General to file an expedited complaint with the Supreme Court against the Northeast Chief Judicial Officer, seeking a temporary injunction against the CJO and empowerment of the Secretary of Federal Elections to administer and certify the regional elections per the Constitution and laws of the Northeast.

Therefore:

Article IV, Section 1, Clause 3 of the Third Constitution states:

It is clear here that the Northeast Region, in such a state of emergency, has chosen, over the last month, to not exercise their abilities to resolve their electoral disputes. With the Assembly unable to intervene on their own, the only remaining body with authority is the Supreme Court.

I request that the Court swiftly move to appoint the SoFE in charge of the regional elections of the Northeast, to do so in accordance with the laws and procedures of the Northeast, as the Northeast region itself is unable to do so, to ensure the reinstatement of the Northeast Assembly and resumption of a proper functioning government in the region.

Speaking for myself, I don't see why the Prez just doesn't use his executive power to command Teddy to open a booth and conduct the election.  Such an action would be legal in my view as the NE hasn't followed its own Constitution which has strict time guidelines. I dont see why the Court should care and more importantly I don't think the Court has the power to grant the relief requested.

What do my fellow colleagues think?

I was unsure of the limits of my authority in this matter. As you seem to be signaling that this is legal, I will immediately direct the SoFE to do so.

Fair enough but my view is that we don't have the authority to grant such power, rather we can only review it's exercise and IMO it would be lawful in this case. So consider this an advisory opinion by one member of the court.

Keep in mind though, that the question of the exercise of the power is not the subject of the complaint, nor are we reviewing any regional laws or disputes IMO. Henceforth, your argument is not relevant IMO and I would deny the complaint with my advisory comment as above.

But I'm only one member, so you'll have to wait.

I appointed him primarily for Wiki work (which he has exceeded expectations on). Former Justice Marokai is my trusted legal adviser. Wink

And I didn't really care what Kal wrote, so long as it prompted you to provide some sort of guidance on how to proceed. You gave me exactly that quicker than I had hoped, so all is well.

I agree with Mr. Chief Justice here.  Our role is only one of review of such actions, not pre-approval.  I would only add that I commend the Government on their scrupulousness and thank them for their consideration of our Branch.
