This is the most awesome Gaslighting Spectacle in the history of this Forum.  I'm truly amazed by the intensity of the various hacks here; they have outdone themselves.

That Joe Biden is in some state of dementia is obvious to millions of Americans.  That some moderators view this as "Excessive Hyperbole" is an insult to millions of Americans who see Biden on a daily basis, even through the filters of the most friendly media possible.

That's not the point, however.  Hur's Report clearly lays out ALL the elements of a crime perpetuated by Biden.  Biden was in possession of classified documents.  He had been taking documents from the time he was a mere Senator, and he took documents when he was Vice President; all without any authorization.  He knew he had these things illegally; and he made statements to his ghost writer to that effect.

The issue of Biden's memory is Hur's "out" from charging Biden.  It's an "out" that most criminal defendant's don't get with their prosecutors.  When Probable Cause of a crime being committed is put forth, a Prosecutor issues an Information or seeks an Indictment.  The issue of the defendant's competency is not taken into account in the charging document; it's an issue for the defense to raise.  And the competency of a criminal defendant is rarely something that prevents a prosecutor with going forth with charges when there is probable cause unless the accused has a history of mental illness that is already well-documented.

If you remove the "memory" issue from Hur's report, there is no reason not to go forth with charges against Biden.  The elements of the crime are documented.  Biden has no credible excuse for his actions, given (A) that he's a lawyer and knew, or should have known, the law governing these documents, (B) that he's been in possession of the documents for decades, (C) that he made statements to the effect that he knew he shouldn't have them.  The insecure location of these documents is mere icing on that cake.  These are the elements of the crime; he had prohibited documents, he took the documents, he knew he possessed the documents, he knew he should not be possessing the documents, and he willfully possessed them for decades after taking them and knowing he shouldn't have them.  And, unlike Trump, he had never been President; he had no ability to declassify the documents in a way only Presidents can.

The reference to Biden being "cooperative" is beyond laughable.  It's pathetic actually.  Biden only cooperated after his decision to charge Trump over documents; had he not done so, he would not have been "cooperative" and, indeed, the documents would have remained in Biden's possession.  If that's "cooperation", the term has been successfully redefined.

But beyond that, "cooperation", for ordinary defendants, doesn't mean that they avoid charges.  People sometimes avoid charges by being witnesses, but this isn't a "witness"; this is the Big Guy, himself.  Cooperation is an argument for leniency in sentencing, but it is not a defense for the act, and it is not a reason for a prosecutor to simply drop charges.  A thief or a criminal can cooperate, give back the money, etc., and even testify against accomplices; none of that is justification for dismissal of charges.

The bottom line to all of this is simple:  Biden needs the Incompetentcy/Diminished Capacity defense to avoid conviction if he's going to be charged.  Yet Biden can't be seen as being of Diminished Capacity to be re-elected.  Even more so, if Biden is of Diminished Capacity to the point where he cannot be found culpable of a criminal offense, that reflects on a veritable parade of pols who made possible a man of rapidly declining cognition.  The public will demand some sort of accountability of those who put forth Biden as a candidate, and who coerced the entire field to drop out.  To say nothing of the forcing of Kamala Harris on Biden as the backup plan.  The Secret would then be out, and no one wants the blame for that.

So if you wish to impugn Hur, go ahead.  Fani Willis will prove to be the Gift That Keeps On Giving.
