The one major problem I can see that this article doesn't even talk about is that this would make judges entirely beholden to the wishes of the masses, and a judge would stay in business not because he or she was right, but because he or she made decisions that made as many people happy as possible, even if it means entirely screwing over one of the parties.  Personally, I find the idea of a judge who always carefully gauges public opinion before making a decision very frightening.

Plus, this article does not even touch on the subjects of what would happen with, say, murderers, or, in the examples he gives, but then blatantly ignores, rapists or bank robbers.
