Good. Hopefully he goes to jail for this too, as a little appetizer.
But that excerpt is interesting - does it mean the DoJ thinks that there are yet more documents out there?

It probably means that there are classified documents that were in Trump's custody in the White House per inventory lists or logs or whatever, which are still missing. This could all be resolved if Trump would just fess up that he destroyed those documents, or handed them over to Putin, or whatever.

I agree that there must have been someone responsible for logs (inventory lists) that clearly say that certain documents went directly to donald trump (into the Oval Office), and did not come back-out.
I can not imagine that there were no (very strong) internal controls in place, to protect these vital and very secretive documents that our federal government is responsible for. Tracking were every single document is/was (who last possessed, or someone higher-up who demanded to keep it) must be recorded.

While there doubtless were such policies pre-Trump, would it really be surprising if the guy who tried (and failed) to flush official records down the toilet ignored them, the same way he ignored so many other laws?

The news hasn't spent much time on how we're now on Trump's fourth "criminal lawyer", with Trump's self-generated claim that he's about to be indicted/arrested taking up most of the oxygen in recent days. However, there is still some coverage, including the revelation that Corcoran was taping his conversations with Trump.

The appeal on Corcoran's evidence and testimony appears to have gone at the court equivalent of transluminal speed. Do we know why?

It seems possible it could be related to national security concerns, or perhaps there's some timing issue I'm unaware of, or maybe the courts are just tired of Trump's bad faith delays.

So, I haven't been following all the ins and outs of this story, but I feel like I should ask this question sooner rather than later: Who is Corcoran? Was he the lawyer who affirmed that all the classified docs had been turned over and none were left at Mar-a-Lago?

Corcoran was a college buddy of Trumpist DoJ hack Tim Shea. That led to him unsuccessfully defending Steve Bannon from contempt of Congress and being one of many lawyers for Jan 6th defendants. When Trump started running low on lawyers willing to work for his preferred compensation - a wrecked reputation and possible criminal charges - early last year, Corcoran joined his defense team.

From there, he represented Trump to the DoJ in their efforts to recover the documents Trump stole, loyally presenting a series of legally questionable arguments to defend Trump. After the subpoena was delivered, Corcoran drafted the false declaration that Trump had returned all classified material.

For some reason, he did not sign the document he'd drafted himself, instead recruiting MAGAT lawyer Christina Bobb to step in as Trump's "custodian of records" and put her head on the block by officially lying to the DoJ. Once the declaration was determined to be false, the FBI executed a search warrant at Mar-a-Lago.

As Jack Smith's special prosecutor investigation got going, Corcoran invoked attorney-client privilege for questions relating to his communications with Trump. After reviewing the communications in question, federal judge Beryl Howard determined last week that Corcoran's communications with Trump were likely to have been conducted to commit or further a crime, and revoked attorney-client protections.

Corcoran and Trump immediately appealed, and the DC Court of Appeals held an incredibly swift hearing earlier this week before rejecting the appeal 3-0. Corcoran will be forced to testify, under oath, to Smith's grand jury later today.

Corcoran's testimony (and other evidence) will be key in determining if:

1) Trump lied to him about hiding stolen classified documents from the DoJ, or,

2) He conspired with Trump to hide stolen classified documents from the DoJ.

In theory, he could try to throw himself on his sword, and go with,

3) Hiding stolen classified documents from the DoJ and then lying to the DoJ about it was all his idea and Trump is innocent.

However, if Smith has evidence that proves 1 or 2, and Corcoran tries 3, then perjury will be a slam dunk.  In theory, he and Trump could try to argue they're innocent and did not deliberately conceal stolen classified documents from a subpoena, but the feds already have a fairly solid case to the contrary.

tldr; in the next 18 hours, Corcoran has to decide whether or not to throw Trump under the bus, hard, or go under it himself.

It's quite likely that this is what Trump has spent the last week trying to distract from, and not genuine concern about the the NY "lying about bribing the sex worker he cheated on Melania with" case.

So, the lawyer who says he doesn't have any evidence Donald Trump shared the secret information Donald Trump stole, is quitting because he hasn't actually be able to talk to his client about the details of the defense he's supposed to be mounting. It seems to me that Donald's strategy of "lying to lawyers  who then lie to other lawyers who will then lie to the Court" is reaching the point of diminishing returns. (Or maybe he just needs to recruit a fresh round of unpaid legal meatshields.)

At this point I think the chances of Trump being indicted for both obstruction of justice and violating the Espionage Act are approaching 100%.


What's the punishment for violating the Espionage Act?

A military buddy I know said something about death penalty, but I highly doubt that would be the case.

It's a fairly controversial piece of law with a convoluted history. Violating the Espjonage Act was the basis for the Rosenbergs' execution, so the death penalty would at least theoretically be a possibility.

Minor note among the celebrations here. I think we can unsticky this thread and allow it to Fall by the wayside in favor of the Trump indictment thread. Maybe let someone create a second one to focus on the documents indictment? Or just continue this one?

I actually don't understand why everyone is posting in the other thread. It was originally about the New York case and the title was changed to Trump indicted when that was the first time it happened so the case itself didn't really matter. But this is still the thread for the indictment that happened today.

Trump has committed so many crimes that we can't even keep track of which investigation we're talking about.

This is actually a large part of his political success. Trump creates a whirling miasma of crimes and lies that surrounds him at all times, making it difficult for the average American to grasp exactly what he's done that was so awful.

He's aided in this by much of the media, such as the New York Times, who seldom fail to amplify his message for him, and often (such as with NYT journalist Maggie Haberman) provide Trump-favorable spin even on negative reporting that seems negative.

Tonight Trump accused Biden of selling classified information to China, says Smith has put the country through hell, said he was deranged again, and accuses the FBI of planting some/all of the documents. See below.

He is a Coward and a Thug!

When the FBI raided Mar-a-Lago, they wouldn’t let my lawyers or representatives anywhere near them. They wouldn’t tell us what they took. Knowing them, and based on past performance, they probably later “stuffed” in other documents. My lawyers had to wait outside, on a very hot day. The FBI took my medical records, birth certificate, and passports, and just about anything else they were able to get their hands on. What a group! They didn’t do this to Crooked Joe Biden or Hillary.

Does everyone know that Deranged Special Prosecutor Jack Smith was in charge of Lois Lerner and the IRS Scandal?
