Yeah, I don't think anyone thinks the FLSA was perfectly written, and I certainly wouldn't mind going over it again to improve the wording or something like that.
With regard to Deus's hypothetical cake stall I'd assume that that would be treated the same way as those videos which say "not to be shown in schools" i.e. ignored, but that definitely is a problem in the law.
The problem here, I think, is another of the balancing acts we have to perform. We don't want Mental Healthcare Reform style bibles, but complicated areas need complicated legislations.
I don't have any real solutions, by the way, short of the pornography answer.
