Since it looks like section 1 will be struck, leaving just section 2, I offer the following amendment to both remove the needless sectioning and make more specific how the money will be spent.

The text of the bill shall be struck and replaced by the following:

1. There shall be established in the National Cancer Institute a David Yates Brain Cancer Research Fund (hereinafter known as the Fund).

2. The Fund may accept donations of monies and other assets.

3. The sum of $10,000,000 is authorized to be appropriated to the Fund each fiscal year and $10,000,000 is appropriated to the Fund for fiscal year 2008.

4. The Fund shall be used to pay for one or more David Yates Brain Cancer Fellowships.  Such fellowships shall be for one year and shall be renewable.  They shall be awarded and renewed at the discretion of the Director of the Institute for research into the detection, prevention, and treatment of brain cancer. David Yates Brain Cancer Fellows shall receive pay and allowances from the fund equivalent to that which would be disbursed to specially qualified scientific personnel hired under section 3104 of Title 5, Government Organization and Employees, but shall not otherwise be considered a government employee.  In addition, the cost of the research undertaken by the Fellow shall be paid from the Fund as authorized by the Director of the Institute.

I'm not generally in favor of these sort names either but for now it is the "Yates" Cancer Research Bill, if someone wants to introduce an amendment to completely de-Yates-ify the bill I wouldn't object, but until it is, might as well give it the full treatment of similar real world bills.

Would the PPT be so kind as to point out where in the Senate rules a bill may be withdrawn unilaterally by the initial proposer once it has reached the Senate floor.  We have spent sufficient time on this bill that I would prefer to see this Senate rather than another finish it because it had to be reintroduced as a new bill.

I'm fairly sure no provision exists, though of course, it is the convention to remove bills when the proposer withdraws the bill.

Agreed, but usually that been done when it has become obvious that vote on final passage would be lopsided with only the proposer voting for the bill, and sometimes not even him, if he has been convinced that it is a bad idea because of the debate on that bill.

Nay on the stem cell amendment and Abstain on the de-Yates-ification amendment that was being voted upon when DWTL called for the bill's withdrawal.

Could the PPT please indicate whether the de-Yatesification amendment has been passed?  Indeed, would he please be so kind as to present a current copy of the bill as amended to date.

Not yet.

I hadn't realized voting was even open on this.

It got interrupted by the attempt to withdraw the bill and then we went on to another amendment when it was unwithdrawn.

Aye.

I wish to introduce an amendment to revise Section 4 to read as follows:

4. The Fund shall be used to pay off the national debt.
Unless the Senator from the Southeast can produce some study indicating at least a positive correlation between national debt and cancer rates, I ask the PPT to reject this amendment as frivolous.

So as to prevent anymore time wasting amendments from being made, I call for cloture on this bill under Article 4 Section 1 Clause 4 of the OPSR.  I'd much rather opponents simply vote nay on final passage than keep bogging the Senate down with procedural nonsense.
