The last time a Justice died (Rehnquist), I believe Roberts was named the successor two days later.

That was completely different because Roberts had been nominated to replace O'Connor who was resigning once she had a successor confirmed.

What happens if the new President isn't a Republican?

We will have 8 Supreme Court justices until someone else dies, at which point, we will have 7 Supreme Court justices.

And then once it goes below 6, they'll just get to twiddle their thumbs all day waiting for a quorum.

The Senate doesn't have the privilege of picking whoever they want for the court.

If the candidates don't mention it themselves, it at least comes up in debates on cable news, written articles, etc. It's part of the job and Obama should be allowed to fulfill it.
But we do have the privilege of shooting down anyone Obama tries to appoint. Obama has the right to nominate whoever he wants, but not to flat out fully appoint them.

If the Senate blocks a reasonable nominee, Obama should call them out every single day on it. Every single day.

Justice Committee Chairman Senator Grassley is now saying that Obama won't get to appoint a new Justice.

LOL @ all the Democrats who voted FF on the poll we had about him recently.

Newsflash: Moderate Senators don't exist.

Not true. Moderate Republican Senators don't exist.

OK I just read the Senate is in recess until Feb. 22. Obama has nine days.

The Senate probably claims they're not in recess.

Oh the republicans are so hypocritical. If they are in the Whitehouse get the most conservative justice....but if the dems are in the white house it needs to be a moderate or they will block. Get over roe vs wade republicans, aren't you guys supposed to be for small government?

Roe v Wade is inherently a big government decision that should have been delegated for states to decide, not the Federal government, calling for it's overturning and relegating that power back for the voters in each state to decide the issue isn't being opposed to small government.

Is Gonzales v. Carhart also a big government decision?

I think this is definitely good news for Hilldog in the primary because she's widely perceived as more electable, but I also think it's good news for Sanders if he somehow makes it through to the general because, though Sanders' floor is pretty high anyways in this polarized age, NO Democrats will defect or stay home now no matter who the Republican nominee is.

Hillary was the one who was weaker in the general election.
