So how are the libertarians going to spin this one into Obama being a terrible fascist and there's no difference between the parties?

They'll attack him for unconstitutionally and tyrannically picking and choosing which federal laws to enforce.

Because laws on the books are always perfectly logical. Here are two laws from New York.

1. Women may go topless in public, providing it is not being used as business.
2. It is illegal for a woman to be on the street wearing "body-hugging clothing".
