Elder is on. The judge didn't even think tax returns were necessary at all.
The statute is quite clear. It says tax returns are necessary to be on a *primary* ballot. Moreover, it is in a Division of the code that says "this does not apply to recall elections".

The statute requires a candidate to submit two sets of tax forms, one the original and one with redactions - including some redactions that must be made, and some that may be made.

If a candidate redacts too much, the SOS makes a copy of the original and redacts the required information.

Apparently, Elder redacted too little, and the SOS interpreted that as being non-compliant.

Hopefully, Weber will be sued for publishing individual tax forms while acting outside the law.

So who are partisan Democrats going to back on the 2nd question?Huh

Seems like a poor idea to not have some sort of stalking horse.
The theory is that in the Gray Davis recall, some Democrats decided they liked Bustamante more than Davis and went ahead and voted for the recall as well.

Haven't Republicans cost this state enough with the frivolous recall? Over $200 million already spent and now we have out of state interests advocating for the Secretary of State to be sued.

If you had your tax return published by a state agent wouldn't you sue?

I don't know why the legislature simply did not refuse to fund this recall based on the grounds that it is too expensive. If Republicans in GOP states can ignore Medicaid expansion that voted approved then California Democrats could have pulled the plug on the recall for fiscal reasons.
Old Man Brown and the Democrats changed the law in an attempt to delay the Josh Newman recall.

The Constitution simply says that when the Secretary of State certifies that there are enough signatures that the recall election will be held within X days.

The Democrats changed the law, requiring county election officials to report raw signature counts monthly, then verify on a delayed basis a month later. Once there were apparently enough signatures, there was a month for signers to rescind their signatures. Fortunately, the petitions are secret or the Democrats would have been hounding signers.

And then after the SOS had determined that there were enough signatures, a cost estimate would be made, and this would be sent to the legislature. Only then could the SOS "certify" what she had already determined to be true.
