Wow in 6 weeks you can hear the heartbeat? Yeah courts were wrong for this.

In the hypothetical, it's not the job of the judge to determine what's life and what's not, but to appraise a case on its constitutionality. If somehow there's a loophole in a law allowing mass murder, than that's what the law says and it's a commentary rather on how we should legislatively (or in this case through an amendment) change what's already written.
