Rand Paul is Filibustering the Patriot Act

Now I am all in favor of Paul doing this, but wouldn't it be better to wait until the Senate is actually debating the Patriot Act/NSA?

Congress has until Friday to pass a bill; they go on holiday for Memorial Day weekend and won't be back until after June 1. So I imagine starting now gets him and Wyden the ability to say they each filibustered the Senate for 18ish hours.
