I don't like camaras used as an "automatic" enforcemnt of speeding or stop lights. We didn't have them in my little burg when I was still doing traffic court, but I
think one still has the same right to contest the case and force the government to prove beyond a reasonable of identifying the defendant as the perpetratoir. That means, in addition to the license plate registration record, as most people regularly lend their cars to others, the photo better give a
damned solid basis for the judge to deteremine in court it's the defendant. And even then if the defendant claims it was (insert family member or friend here) who looks like Defendant and borrowed the car but wouldn't come to court because they didn't want to get a ticket themselves, there had better be an
AMAZING reason to find otherwise.
That said, a limited, well thought out and crafted limit on the use of traffic camaras
specifically for such uses may've been appropritate. But no, not here. Do you all realize that, intended or not, this bill prohibits the use of
video camaras for enforcing
all traffic laws as well?
Including dashboard camaras? As in the type used for decades to document field sobriety tests in DUI arrests?!? For that matter, as this basically removes the need t ever use such camaras in traffic stops again, there won't be video footage to protect defedant's rights from abuse either.
Congratulations guys. In an effort to stick it to "the man", without a single dissenting vote you just set backDUI prosecution 30 years and left the field open for the tiny minority of bad cops to wreck havoc on arrested person's
And may suddenly ending that yesterday for a real life case should tell you what work is like to kee me frm posting so much lately.
