Looking at that list, it reads like 57-43 to me, with Manchin, Tester, King, Donnelly, and Heitkamp going for cloture. Followed five minutes later by the nuclear option.

add Warner, Bennett, and Coons, and that's 60.
A) I think its more 56-44 I don't see King going over heck I can see Tester as well also B) Warner, Bennett, and Coons are not likely yes

They may not vote for him, but they will support allowing a vote and save the filibuster for another day.

Except on Politico it says (well more than says, it has up a video of Coons actually saying it) that Coons thinks there is not 60 votes, and the "tragedy" of the nuke button being successfully pushed is "almost a certainty."  So Coons has trouble getting to the number 60.


Schmuckey better cut a deal with McConnell because the next guy isn't going to be anywhere near as milk-toast as Gorsuch, and if McConnell pushes the button then, the Dems are truly screwed.
There is no guarantee Trump gets a next guy an if he does it might be replacing a consertive justice so go for it

Agreed, no guarantee but at 84 for Ginsburg it's reasonable to suggest she may be next.  Kennedy is no spring chicken either.
That generation is still holding on so I wouldn't beat on it an Kennedy is replacing rw with rw

He's not a right winger on the only abortion that matters. His departure would mean saving millions so he better hurry up and get on with it.

Agreed. I sent an angry email to Sen Warner today calling him a hypocrite, a coward, a dissapointment, and informing him that he wouldn't get any more of my votes since he's decided to become a hack without principles and treat a good judge like garbage. Sent a similar email to Sen. Kaine, but i never voted for him so it was less preachy and indignant.

Give me a break. Republicans didn't even try to nominate a consensus candidate.



And Democrats didnt even pretend to give Gorsuch a fair hearing, which they just spent an entire year whining about. Yes i know, "iz a stolez seat. Teh rules say the Democratic Party forever owns that seat."

At least they had the courtesy to give Gorsuch a hearing. I can't say the same for the Republicans who treated Garland like garbage.

Obviously different circumstances when you are the minority and don't have much of a choice. Roll Eyes Just like the Republicans chose the politically advantageous side back then, the Democrats simply chose the most politically advantageous thing today.

Better not conduct one at all than conduct one under false pretenses when a confirmation is not possible and thus only serves to disadvantage you politically.

Had the rules not been changed in 2013, the nuclear option would still be viewed as unacceptable, and this would not have happened.


Republicans do not care if something is acceptable or not. They will make it acceptable.

if it was solely about Gorsuch he'd have well over 60 votes  to end debate and confirm him.  This is f[inks] Trump and the Pubs.  This isn't even about Garland, the person.  If Hillary was elected they wouldn't even care if she didn't re-submit Garland's name.

     Yeah, this was never about the people involved. The intellectual dishonesty of Schumer suggesting that it was disppointed me a little, but was not surprising. I would have had more respect if he could have just come out and maintained that they would be obstructing Gorsuch's nomination in protest over the obstruction of Garland's nomination.

GOP did Garland wrong. No doubt on that. But I support confirmation of Gorsuch because I am not playing this game of attempting to keep vacancies vacant under the next Democratic president. And there is guarantee that justices will be ideologically stagnant throughout their tenue.

You mean, they did Garland right. The huge risk paid off boatloads.

Sir, what was done to Merrick Garland was wrong. This was not against Merrick Garland it was against Barack Obama.  

This was a vacancy that the last president was supposed to fill not some clown.

It was not against anyone. It was for what is right. The seat was no more Obama's than Scalia's than Trump's than Garland's. If you have the power to do what is right and do not do anything to stop it in the name of respectability politics, that is cowardly. I dearly hope Mitch McConnell's simple majority helps guide us through many more losses on the Court.

I've reached the point where I am deeply ashamed of my McGinty vote. Thank goodness there another Plan in the works.

Alot of lefties on twitter and Reddit seem to be really freaking out over this but im not sure why. The filibuster has been abused to point that it lost its purpose. That means its best for the health of our representative republic to get rid of it. If the healthcare bill failing is proof of anything, even partisanship fails when a proposal is bad enough, and thats the way it should be. I hope the legislative filibuster goes next.

You have the luxury of assuming Congress will never pass anything you deem "bad enough", lucky you but not all of us are in that position.

Let's hope there will be another retirement/vacancy or two, so we can make more forward progress.

there are rumors that Kennedy could retire in the fall, and RBG has been in poor health for years

Kennedy needs to go ASAP. He is literally the worst - or one of the worst - types to be on the court. This is the least he could do.
