These debates are classic arguments of negative vs positive rights. In this case, the right to be nude in public (freedom of expression, etc) and the right of the public at large to leave their home free from the uncertainty of being blindsided by a nude Glad bag filled with oatmeal claiming first amendment rights. I'm inclined to side with the latter on the grounds of social contract and collective interests.
Furthermore, we already have designated areas in which public nudity is allowed -- namely naturist resorts and strip clubs. Why does nudity as a right be extended to all public places? What benefit would this bring?
