As Solicitor General of Texas, it was his job to fend off challenges of existing Texas laws in court. It's ridiculous to use this as something other than a man doing his job.
He did the dillegence in defending it and lost, and then appealed the decision!
Because that's his job. To defend acts passed by the Legislature.
While that is true, there is discretion on which cases get defended by the state AG and SG. We saw a number of states choose not to have their state officials defend their own anti SSM laws for example. It would be a fair question to ask Cruz which defenses he agreed with. It is noteworthy that he and Abbot didn't appeal to SCOTUS. I suspect neither of them wanted to be introduced to a national audience as the guys defending the banning of dildos.
