Heller is definitely in a rough spot. He can't vote Yes, but other Senators know this and are waiting for him to oppose so that they can too. Portman, Murkowski, and Capito would come out against this if they knew there were already three votes against, which means, barring some generosity on their part, the ball is in Heller's court.

S**t, this might get passed if none of them speak up and they are all herded along waiting for someone else in their group to voice an objection

I'm thinking this eventually passes for exactly this reason--nobody is willing to take a stand on their own.
