Breyer was gonna tease us this yr, but realistically, he still has another yr to think about it, he isn't on his death bed or neither D Senator, if Leahy was ill like McCain, he would retire

Breyer isn't  dying of cancer, we knew Ginsberg was dying since 2014 and she was holding out hope in 2016 Hillary was gonna get elected and we were gonna have a Secular Crt with Garland

Breyer has no such cancer, and Mcconnell was just putting that out there, that he wouldn't put a judge on Crt if Garland died to generate enthusiasm with his base.

Ginsberg was hospitalized many times before she died, Breyer trips to hospital, zero

But along with Ginsburg and Breyer they said Crt packing wasn't justified because the Crt should come together, and they did on Obamacare, but the Conservatives stuck together on VR, we need a 7/6, majority, we can win between 51/55 seats and keep the H, should we win 55 seats the Filibuster will be abolished and lowered to 55 and we can get Crt packing done the right way.

That's what this Election is about

Democrats should have tried harder to persuade him to retire. He's making the same mistake RBG made.

Ginsberg was hospitalized many times before she died and she had colon càncer apples and oranges, Breyer has zero hospitalizations, who so you think is persuading him to stay on, Roberts, he is a maverick and he likes all his members, that's why he says don't Crt pack, they are a family

Imagine unironically agreeing with Matt Yglesias. In any event, no, it's not at all unreasonable to understand that the guy whose #1 stated desire in recent years has been to not do anything that adds to the public's perception of a politicized Court isn't apparently all that keen on bowing down to the demands of those who are explicitly demanding that he do something for a wholly partisan political purpose. Anybody who thinks that such demands would've ever actually served to have convinced Justice Breyer to accede to such demands are mistaking him for a brainless - let alone hypocritical - idiot. If one understands that his goal is to make the Court &, by extension, the justices thereof seem less partisan & politicized than the public already believes them to be, then how anybody could think that demanding his accession to such a steamrolling partisan affair as the actions of Demand Justice & the like have appeared to many to be is beyond me.

Refusing to retire and then dying in time for President Cotton to appoint a replacement isn’t going to make people perceive the court as less politicized. It’s just going to make them perceive Breyer as a naïf.

Dems have just as many targets in 2o22 Senate races as 2o2o:2022- IA, FL, OH, AK, NC, WI, PA 2o2o IA, NC, MT, KS, TX, AZ, CO, ME if not the H they can hold the S and are favored

We won't win all but WI, PA, OH, NC, AK and IA can create the wave we need to keep the H, we only need several to create a blue wave, Trifecta gives us DC Statehood and Crt packing, Add 4 justices and we don't have to replace Breyer

If D's win in 2022 they can Crt pack, any blue wave will keep us in control of the Trifecta and no new Senator that is running against an R except Gross have committed not to Crt pack

So the odds are in our favor to Crt pack should need be

All of that and quite a few lower court seats to fill as well. Another bright side is that the Senate Judiciary Committee won't be tied up for a month or so. There's a lot of work to be done in filling lower court vacancies. They're not just rebalancing the judiciary, but they're the future circuit court judges and Supreme Court Justices. I'm hoping Congress will either cancel or at least trim its August recess.

If it's any consolation, "the August recess is clearly at risk," per Punchbowl late last week.


Maybe we'll get lucky and Alito will announce his retirement first next spring. Tongue

Ha, yeah, but there's only one way that Alito leaves the Court during a Biden presidency & it involves no good luck for him.

Blame Biden that's why he will never make my Fav Prez list only Obama, since he asked Anita Hill why now and allowed Clarence Thomas to a floor vote despite a Dem Judicial Committee and only Paul Simon on the Committee voted afainst


He asked the question to Anita Hill just like Cosby women waited til 2004/ to accuse Bull Cosby, why now

Museums as History books will judge Biden Harshly on the Clarence Thomas contradiction, it's been the single reason, THOMAS, as the sole REASON SINCE 19911 THAT THE CRT BEEN ABLE TO STAY CONSERVATIVE, HE HAS BEEN ON THE CRT SO LONG

This is what happens when you live under the delusion that the court is not political. He's demonstrating a really disturbing inability to learn from what happened when Ginsburg didn't retire when Obama could have chosen her successor. Kagan must be pulling her hair out.

You do realize Ginsburg was hospitalized and had her colon removed before she died, right, BREYER DOESN'T HAVE COLON CANCER AND NO SURGERY TO REMOVE COLON OR LARGE INTESTINE, the same procedure Pope Francis is suffering from


Biden is likely to get reelected, Ginsburg didn't retire she thought Hillary was gonna be Elected and she would.finally serve on a 5/4 Crt with Garland

Ginsberg was also expecting Hillary Clinton to win the Election over Trump, remember Bill Clinton appointed her and she would serve on a Secular Crt and implement a liberal wishlist, anti gun rights, SSM, getting rid of Citizens United and Gerrymandering, FINALLY. She was a Law Clerk and Student of Thurgood Marshall

THATS WHY SHE WENT AFTER TRUMP, BUT WHO WOULD BE THE ONE TO LOSE TO TRUMP, BENGHAZI HILLARY

We don't know how Ginsberg died, she was speaking and talking before she died and most people go blind or deaf or stop speaking, her children never go on TV to talk about their moms death. She wasn't in hospice either

CJ Roberts likes all his members and he said that after the passing of Ginnsberg and urges D's and Rs to not retire, Ginnsberg didn't have her colon removed until she was on her death bed

That's why Breyer hasnt retired Roberts, once again urges his members not to retire

But, children of SCOTUS don't appear on TV, except for Scalia children whom were very vocal about how their father died, all the other children stay away, we don't know how Ginsberg died she wasn't in hospice, usually when you die from colon cancer, you go into hospice, GINSBERG SAID SHE AINT RETIRING BECAUSE SHE WORKS OUT

D's cannot push Breyer out they will win WI and PA in Midterms in the Senate and if it's a wave win OH, NC and MO Senate Seats, D's are in Good position to keep the Senate in 2022

I'm starting to see Breyer as an HP. It was one thing for Ginsburg not to retire. It's quite another for Breyer to refuse to after seeing what happened to Ginsburg.

It's very disappointing, I completely agree. I think Breyer sees himself as kind of an institutionalist and believes justices should retire whenever they want or free from political calculations. In that sense, he's like Manchin, who so much believes in presumed "institutionalism" that he overlooks the very fact McConnell and the GOP are playing by a different set of rules what may ultimately destroy the institutions they want to protect. Breyer doesn't want SCOTUS too political and hasn't realized it already is. Institutionalism of that kind only works when all participants play by the same rules.

Feinstein our SEN Said that Breyer shouldn't retire and said it would be a great loss to lose Breyer

He really has until 2024 to retire D's are gonna net gain seats in SEN WI AND PA 51(49 SEN probably going RED GA in a Runoff

D's aren't losing the Senate the last poll in NH showed Sununu loosing ground the Generic D was leading Generic R 45/43 and we still have Ryan, Beasley and Nixon if he decides to run as wave insurence, any blue wave will keep the H

But, it's gonna be difficult with DeSantis leading in FL and no VR to keep the H

No need for him to retire, walk away, whatever before the Dems actually lose the Senate (which might not even happen). In the interim, if he dies he'll be replaced by a liberal.

The thing is, that could happen at any moment. If a Democratic Senator dies or has to step down in a state with a GOP governor, we lose the Senate instantly. He needed to retire earlier this month.

(No offense, but) I trust Breyer, the pragmatic former Senate staffer, to be more informed about the likelihood of such a possibility - maybe by having talked to Leahy about the current state of his health or something - than a random netizen.

D's are likely to hold the S and if we get OH, NC, MO Nixon, as well as WI and PA we solidify Statehood with a wave in the, thru 2024 so Breyer has plenty of time to retire Rs aren't winning the Sen because Sununu polls have cratered

It's either gonna be an RH DS or Secular Trifecta, thru 2024

Breyer wants to serve on Appeals Crts when he retires something that Souter is doing or have done and so has OConnor, GINSBERG didn't want that because she had cancer anyways, Breyer has only hired clerks for one more term, he's gonna retire next yr

He also dropped hints that he doesn't know his plans beyond this term
