No, but telemarketing does create job opprotunities and it (occasionally) works and actually sells prodcuts.

Ugh, those are some crappy jobs!

But I agree with you for free speech reasons.

This is a better solution than the complicated and oppressive Do Not Call List.

What's oppressive about the Do Not Call List?  Its only feature is essentially enabling citizens to disallow telemarketers from coming into their home.

They already have that ability through, as was noted above, turning off their phone.  They may also not answer it, or screen the calls. 

Putting the burden of consulting some list upon the speaker results in an enormous chilling effect on speech.
