When the IRS whistleblowers did their depositions, one mentioned that one of their bosses had complained that there were emails that made this case "unprosecutable". It's not known what they meant, but speculation is that somebody in Trump's White House &/or Barr's DOJ was pressuring the IRS to find a crime to charge Hunter Biden with, & if it's true that there's prima-facie evidence establishing that, well then that's game over on Hunter's selective prosecution motion... & so, the whistleblower festered anger at their boss at the IRS for not still pursuing prosecution, just seeing their excuse as evidence their boss was biased against prosecution, instead of ever considering it possible that their boss at the IRS was correct.

You can never win with these guys.

Yeah, there was no universe in which Scarsi was gonna be sympathetic to selective & vindictive prosecution, even ignoring the very high bar to meet proving them & that judges are always skeptical of them, but appeal may be interesting based on the coverage of him coming across at last week's hearing as unfamiliar with chunks of the actual public record in this case, & if this ever does ultimately end up making its way to actually being tried in front of a jury, then god help Weiss if he seriously thinks that Lowell & the jury won't be best friends by the trial's end.
