I am more concerned about draining terrorists of information we can get using legal methods of "persuasion" before they are dumped into the legal system. After that, I suspect any reasoned cost benefit analysis would suggest that civilian courts rather than military tribunals are preferable, if only for our image abroad. If because of security considerations, not all evidence can be adduced to convict the perp, well then send the perp back from whence the perp came. They will deal with it.
The law is not a suicide pact, but there is no reason to twist the law in a dumb manner, if it can be done without dramatically increasing the odds of something catastrophic happening.
