Anti-CARLHAYDEN Bill

Section 1: Current Status of Illegal Aliens
1. No hospital or place of medical care may deny treatment to a person based on their status as an alien or noncitizen.
2. Within two weeks after the passage of this act, employers paying below the minimum wage to illegal aliens shall be prosecuted as if they were paying below the minimum wage to legal workers.

Section 2: Amnesty
1. Any illegal alien who is not suspected of terrorism charges, or has been convicted of murder, rape, or high robbery, may apply for citizenship one month after the passage of this act.
2. No person shall be denied citizenship based on their status at any time in the past as an illegal alien.
3. No person who is an illegal alien upon the passage of this act may be considered for deportation solely because of their alien status, and all charges pertaining towards their status as an illegal alien will be dropped.

Add a new Clause to Section 2 saying:
Must have been in the country for at least 10 years, hold a steady job or be the supporter of a family

That's ridiculous.  Not even most legal immigrants fit all of those qualifications.  What about a married couple, who are both illegal aliens, who have a child here, (who, under American law anyway, gets automatic citizenship).  The husband has obtained a steady job and is supporting his family.  The wife isn't financially supporting her new child, but staying home with it.  This means the husband could apply for citizenship, but the wife could not.

The word is or meaning they only have to one of the qualifications.  I will still vote against the bill but this makes it better

I named a circumstance in which the woman meets none of the qualifications.

We are voting on whether to amend Section 2, Clause 1 as follows:
Any illegal alien who is not suspected of terrorism charges, nor has been convicted of an offence and sentenced to a term of imprisonment greater than 12 months in duration, may apply for citizenship one month after the passage of this act.

The amendment passes.  We will now vote on DWTL's amendment to strike Section 1, Clause 2 from the bill.

Aye, c'mon people the bill is awful but let's at least make it better.

The problem is that we don't have a list of what crimes constitute felonies, although I suspect that certain things (such as having consensual sex with your relative, or using cocaine) may be considered a felony and even if you think those things should be illegal I wouldn't bar someone from entering the country because of them.

Will every amendment I propose get voted on?

Yes, but if you're attempting to lodge a filibuster, I will motion to end debate.

Ok, one more serious amendment and then you can motion to end debate, I think there is a serious issue as to when and how this amnesty will take place, so I propose:

Section 2.4: An illegal immigrant may apply for amnesty one year after the passage of this bill
Section 2.5: A quota of 200,000 illegals will be allowed to apply for citizenship each year.

What is the rationale for 2.5?  Allowing 12 million people to apply for citizenship is still more practical than deporting them.

The rationale is that having this mass influx of new citizens at once, and let's be real many will need government programs, is too much to handle.  We need this to be a gradual change.  A green card raffle if we must.

But this sets a special limit based on their previous status as illegal aliens, which is against the spirit of the bill.  They should/will be considered new immigrants applying for citizenship legally.

Voting on this amendment ceases because it has been withdrawn by the sponsor.

I propose an amendment to add a Section 3 which will state "The five year waiting period applied to legal immigrants seeking to apply for citizenship is removed."

Voting on some sort of amendment to deny amnesty to workers "having committed the crime of using a fake identity or social security to gain employment or other benefits."

So, does anyone want to add an anti CARLHAYDEN provision?

I don't recall a similar brouhaha when the Senate was debating the Anti-Opebo Bill.

Fine, I would like to change the name of the bill to "Illegal Immigration Bill."

Now we have another DWTL amendment to vote on, two new clauses to be added to Section 2.
"4. An illegal immigrant may apply for amnesty one year after the passage of this bill
5. A quota of 200,000 illegals will be allowed to apply for citizenship each year.
"

To this new Section 3, I would also like to add these new clauses.

2. Section 212(a)(10)(A) of the Immigration and Nationality Act [8 U.S.C. 1182(a)(10)(A)] barring the admission of practicing polygamists shall be repealed as of fiscal year 2008.
3. Section 278 of the Immigration and Nationality Act [8 U.S.C. 1328] banning the importation of aliens for prostitution or other immoral purposes is repealed as of the end of the current fiscal year.

Was this passed or is it a seperate amendment?  B/c you only got one "yea" vote for it

The aye vote was for the previous amendment.

That said, we will now vote on whether to add to Clause 3:
"

Aye

This amendment takes two parts of Ernest's immigration reform bill which I find to be of good merit and adds them to this bill, since I don't intend on voting in favor of that bill.

Well, I copied it straight out of Ernest's bill, and I interpreted it more to mean that people wouldn't be banned from entering the country because of those things.  It's not my intention to actively seek prostitutes to come join the country.  However I will withdraw the amendment to speed things along.
