David Gergen, an adviser to the Nixon, Ford, Reagan, and Clinton administrations stepped up to defend Berger saying that the he (Berger) took copies of the documents but left the originals.

Okay so if I take highly sensitive and classified nuclear schematics and security information and sell them to Al-Queda it's alright because they are just copies, right?

Are the originals still there?  Yes.
Was he allowed to access them?  Yes.

Was he allowed to remove them (or make copies of them)? No.
