Per Dave Wasserman, the Hart campaign claims that updated recount totals will show Rita Hart ahead by 3 votes.

Miller-Meeks Campaign says Recount in Scott County is "Illegal":

The Campaign says that Scott County used a "Hybrid" Model which isn't allowed under Iowa Election Law. The Iowa Secretary of State's Office specifically said Counties must either use "Iowa's reliable Optical Scanners" or do it by "Hand" but not both which Scott County did.

"Iowa law requires a recount in each precinct to be conducted either by Iowa’s reliable optical-scan ballot tabulating equipment or by a hand count. The Iowa Secretary of State has instructed recount boards to use one or the other, but not to combine the two. Most recount boards have complied with that law, but the Hart campaign has advocated for an illegal “hybrid” model in Democrat-leaning counties. The Scott County recount board, over the Miller-Meeks for Congress campaign’s objection and against the instructions of the Secretary of State, adopted this method."

Conclusion: This will end up in Court as well especially if Hart gets ahead!

They did the machine recount and then checked the ballots that couldn't be scanned?

Seems petty.


Under Iowa State Elections Law they are not allowed to do that. Either you do the entire Race in your County by Machine or by Hand but not both. This Race is going to end up in the Courts and if the Miller-Meeks Attorneys can proof to the Judges that Scott County violated Iowa State Elections Law then the entire Recount of Scott County will be thrown out.

Would the entire recount of the county be thrown out? Or would the county just be reordered to do the recount in a way that's consistent with Iowa State Law? It doesn't really make sense to just throw out results and potentially disenfranchise voters because they used a "hybrid" approach (and with an election this close, throwing out recount results entirely, even in just one county, very well could change the result of the whole election).

With a margin that close, there's a legitimate argument to hold a special

I was wondering the same thing. Perhaps they would do a second recount to see if the same candidate won before getting to that point, though?

There is precedent for this, with the 1974 and 1975 Senate elections in NH. Could something like that occur in Iowa?

This article gives a really good summary of where things stand in IA-02:



The state of Iowa is set to certify statewide results on Monday at 3:00 pm. I imagine IA-02 will be a legal battle for awhile even after Monday, though?

Clinton County finished their recount today. I believe this is the last county to finish their recount, and it ends with Miller-Meeks having a 6 vote lead in IA-02. The state is set to certify results on Monday:



I wonder, does this spell the end of the IA-02 race, or will Hart bring this to court?
