The PEOPLE (62%!) voted for this administration, and all the past administrations which the Attorney General has served. The Attorney General’s tenure has been an execution of the will of the people and a vote to convict is a usurpation of the will of the people. If you want a different Attorney General, elect a different President.

Those 62% voted for OBD long before the Kansas crisis even started.

What right does the senate have to judge me? What right does the senate have to interpose in arresting the will of the people?

The pretended charges which these senators bring against me are the final act in a desperate conspiracy born in the last days of Federalist misrule, which has festered and spread in darkened hallways and smoke-filled rooms to involve high officials in every branch of government represented in this city. The state department, the senate, the court, the sniveling ministers of the southern Region, not to mention the vipers in the press, are combined against me; in their pursuit of their aim they show now regard for laws, for constitutions, or for the ordinary conventions of government. The constitution in their hands is an instrument for oppression and lies; it is a threat issued by the privileged minority to the masses: it is the whispered threat of violence perpetrated against the people, first in Kansas, in time throughout the whole nation everywhere where there is resistance to tyranny.

What we are seeing in Kansas is only the first act of the war that will end in the permanent subjugation of the working people of this country, of the states of the western commonwealth, to the cruel domination of eastern money-changers and foreign interests. The fascist element has never given up hope of ruling this country. They were frustrated in 1933, when their strategies, so successful on the continent of Europe, proved ill-adapted to the sense of patriotism and love of liberty which yet prevailed among the people. Their aims were for a time arrested; but the progenitors of that plot were never brought to trial. Their sons and grandsons walk among us today in the guise of ordinary citizens; but secretly, the plot against the nation smoldered, changed shape, developed appetites. At one time most of the national security apparatus of the country was directly or indirectly controlled by a small circle of influential men having as their aim the establishment of a fascist dictatorship over these states.

The enemies of this nation knew that before their plans could proceed I must be removed from the Cabinet and the administration of the department of justice. After the defeat of their first attempt, they had turned to statues and regulations to slowly erode the identity of the people. The language of the law became an instrument of control —words, words, words, words spun to confuse, beguile, and frustrate all efforts to challenge their creeping control of the state apparatus. Opinion, precedent, interpretation and consensus were the means for whittling away the ability of the people to resist the encroaching tyranny.

The substance of their arguments is nothing —words, words, words, words spun to bamboozle and deceive the masses. They sought to make the law so incomprehensible that the people could not make head nor tail of it, and so would be forced to rely on authorities to explain it to them. Words took on a malleable and ethereal meaning: the law meant whatever the lawyers said it to mean. The sense of the people was obscured, and their vigilance lulled into slumber, in anticipation of the main event.

The objection which these senators take to my administration of the justice department is not, as they pretend, that I have acted contrary to the good conduct of the law. Many of their best friends are secessionists and criminals, and they have sought many times to subvert the laws and the constitution on their behalf. They object to me because I have beat them at their own game: I have refused to accept their terms for the debate, but have taken the fight to the people and won. Now they seek to remove me by a groundless, heretical, and unsubstantiated attack on my office.

I say, if the enemies of this nation will vote to remove me from office, the eyes of the people will at last be open to the true nature of things.

They will see the laws and the constitution for what they are: the instruments for the abuse and oppression in the hands of their lying counselors, the so called "senate" of this republic. They will at last understand that when senators cry "law and order," what they seek is the unilateral disarmament of the working class to facilitate the progress of capital unimpeded by laws, elections, or legitimate courts. They will understand the peace of the land to exist under the veiled threat of violence against any who challenge the monopoly of capital which is established in the privileged minority who call themselves the senate.

When the people are aware of these facts, they will not any longer have a reason to obey laws which protect not their rights nor secure them from harm. They will then cease to restrain themselves from the forceful expression of the right of the majority to make the laws of the nation without reference to fancied laws or constitutions.

If the senate wishes to inaugurate open war between labor and capital, they shall have their war. Labor will not hold back her natural strength in such a conflict. John Brown was hanged for treason against the state of Virginia. Nat Turner, Charles Deslondes, and Gabriel Prosser were all called rebels and law-breakers. It is the favorite trick of the slave power to use invented forms and twistifications to condemn any and all who challenge their monopoly on wealth and political power.
