The Washington Supreme Court has denied the Democrats request to order counties to re-examine previously rejected provisional and absentee ballots:

Counties have the discretion to address problems they found in the initial canvas, such as King County's discovery of 561 absentees rejected because (they claim) they were compared against in invalid database.

If there are valid votes that have not yet been counted, they should definately be counted.

Just for the record, it is the Democrats in Montana that are trying to keep votes from being counted in the race that will decide who controls the lower house.
